- Mandatory HMO licensing in England applies to any property where 5 or more people from 2 or more households share facilities, regardless of the number of storeys since October 2018.
- Renting out an unlicensed licensable HMO risks an unlimited fine on prosecution or a civil penalty of up to £30,000 per offence, plus a rent repayment order of up to 12 months' rent.
- A house shared by 3 or 4 tenants is an HMO but needs a licence only where the council has an additional licensing scheme, there is no England-wide licence requirement below 5 occupants.

With 3 or 4 tenants from 2+ households your property is an HMO, but mandatory licensing starts at 5 people. It hinges on your council's additional licensing scheme.

When is an HMO licence mandatory in England?
When the property is occupied by 5 or more people forming 2 or more households who share facilities such as a kitchen, bathroom or toilet. Since October 2018 this applies regardless of the number of storeys.
Do I need an HMO licence for 3 tenants?
Not under mandatory licensing, that starts at 5 people. Three tenants from more than one household make the property an HMO, and it needs a licence only if your council runs an additional licensing scheme covering it.
What is the fine for not having an HMO licence?
On prosecution the fine is unlimited; alternatively the council can impose a civil penalty of up to £30,000 per offence. Tenants or the council can also reclaim up to 12 months' rent through a rent repayment order, and no valid section 21 notice can be served while the property is unlicensed.
What counts as a household in an HMO?
A single family unit, a couple, or relatives living together, count as one household however many people that is. Unrelated sharers are each their own household, so 5 friends sharing are 5 households.
Does a live-in landlord need an HMO licence?
Not with up to 2 lodgers, a property occupied by a resident landlord and no more than two lodgers is not an HMO. With 3 or more lodgers the exemption is lost and the normal HMO tests apply.
What are additional and selective licensing?
Additional licensing is a council scheme extending HMO licensing to smaller HMOs (typically 3–4 sharers) in a designated area. Selective licensing requires a licence for every privately rented property in a designated area, HMO or not. Both are council-by-council, check your council's current designations.
